Update on clinical negligence proposals from Deborah Evans, Chief Executive APIL:
I have today received a letter from health minister Ben Gummer in which he says that due to the delay in the consultation on fixed costs in clinical negligence claims being published, the Department of Health recognises that an implementation date of 1 October for any proposals is now not achievable.
Having been aware of the concerns members had about an October implementation date, I wrote to Mr Gummer last month explaining that there would now not be enough time for law firms to prepare properly for any changes.
In the letter, the minister gave no details as to when the consultation will be published, but said that the proposals would be implemented as soon as possible following the consultation.
